Legal Services of the Hudson Valley (LSHV) is committed to maintaining the privacy of our website visitors and donors and maintaining the confidentiality of your personal information. LSHV collects and uses personal information such as name, address, phone number, and email address to process and acknowledge donations accordingly. LSHV does not sell, trade, or share its donor list with any other organization, although it does publish a general list of contributors in its Annual Report and website each year as well as include information as required in its IRS filings. All personal information provided to us is stored in databases located on servers which are behind firewalls and all donations made online are encrypted using the latest in encryption technology. We will use your contact information to keep you informed about how donations are used as well as the important work being done by our organization. Legal Services of the Hudson Valley (“LSHV,” “we” or “us”) offers a Text Message Program (“Program”). By signing up for the Program, you agree to these terms and conditions  (“Program Terms”) and acknowledge our practices described herein and in our Text  Message Privacy Policy below. By signing up, you also authorize LSHV to deliver to the  designated mobile phone number short messages for administrative purposes such as  establishing initial contact, making appointments, and reminding you about appointments  and court dates. You are not required to accept these Program Terms as a condition of  receiving legal services. Phones must be able to receive text messages to participate in this  program. 

You can unsubscribe from the Program by texting by calling or texting your attorney, if you have been assigned one, or our intake line at 877-5748529 if you are a prospective client. You hereby consent to receive a text message confirming that you have unsubscribed, as well as other non-promotional text messages such as when you join or any unrecognized  message, and when we send you administrative messages. 

You agree to promptly notify us if your phone number changes or you do not continue to own and control the device assigned by your carrier to the number you provided us by  contacting your attorney, if you have been assigned one, or our intake line at 877-5748529  if you are a prospective client. 

The Program may not be available in all areas. You understand that message and data rates may apply, and your carrier may charge you or deduct usage credit from your account when you text us or we text you and you consent to that. You represent and warrant that  you are the age of majority where you reside (18 in most states) and you reside in the U.S.  and are using a U.S. mobile number to subscribe. Carriers are not liable for delays or  undelivered messages. The Program may not be supported by all carriers and all devices. 

Forum Selection/Jurisdiction. 

Jurisdiction and venue for any controversy, allegation, or claim arising out of or relating to  the Program, these Program Terms or any applicable additional or different terms and/or conditions that may apply, in some instances, to your use of the Program or to a service or product offered via the Program, shall be in Westchester County, New York. You and we  submit to personal jurisdiction and venue in Westchester County, New York for any and all purposes.

This Text Message Privacy Policy describes the information we may collect from you and our practices for collecting, using, maintaining, protecting, and disclosing that information when you use our text messaging communications service (the “Text Message Program”). We will only use our Text Message Program to send short messages for administrative  purposes such as establishing initial contact, making appointments, and reminding you  about appointments and court dates. 

This Text Message Privacy Policy does not apply to our data collection activities outside of our Text Message Program or the data practices of any third parties.

LSHV may use information about you for the following purposes, and other purposes as permitted by law:

  • to provide you with information or services that you have requested or agreed to receive, including to send you text message communications; 
  • to prevent unauthorized, improper or illegal activities within the Text Message Program; and 
  • to carry out our obligations and enforce our rights. 

4. INFORMATION WE SHARE WITH THIRD PARTIES
Except as noted above, LSHV does not disclose or share your personal information with third parties or affiliates. Your consent to our Text Message Program (i.e., text messaging originator opt-in data and consent) will not be shared with third parties or affiliates. However, subject to restrictions under applicable law, our service providers may use your personal information to provide services for us and may engage their own vendors to help perform services for us related to the Text Message Program.

5. CHOICES PROVIDED TO YOU REGARDING YOUR PERSONAL INFORMATION
Please contact us to correct or update your personal information, or to opt-out of the Text Message Program. Further, we reserve the right to retain data (i) as required by applicable law; and (ii) for so long as reasonably necessary to fulfill the purposes for which the data is  retained as permitted by applicable law. 6. DATA SECURITY AND MONITORING
We aim to incorporate commercially reasonable and appropriate safeguards to help protect and secure your personal information. However, no data transmission over mobile networks, wireless transmission or electronic storage of information can be guaranteed to  be 100% secure. Please note that we cannot ensure the security of any information you transmit to us, and you use the Text Message Program and provide us with your information at your own risk.

7. UPDATES TO OUR TEXT MESSAGE PRIVACY POLICY
We reserve the right to change this Text Message Privacy Policy from time to time, and it will be prospectively effective upon the posting of the revised Text Message Privacy Policy. Your use of the Text Message Program indicates your acknowledgement to the privacy policy  posted at the time of use. To the extent any provision of this Text Message Privacy Policy is  found by a competent tribunal to be invalid or unenforceable, such provision shall be  severed to the extent necessary for the remainder to be valid and enforceable.
