It’s Never Too Early to Plan Your Estate

According to AARP, more than 60% of adults do not have a will or estate planning, despite it being an essential part of preparing for the future. Preparing a will and your estate plan allows you to specify how you want your assets distributed after your passing and designate a person to manage your estate. If you are part of the population without these plans in place, you could find yourself in a similar situation to our client, Jim*.

Jim is an elderly veteran who lives with his wife and is the unfortunate victim of elder abuse at the hands of his oldest daughter. To prevent further abuse of his estate after he and his wife passes away, Jim contacted Legal Services of the Hudson Valley (LSHV) to ensure his home and proceeds from his estate would go to his two younger daughters.

Deanna Arden, Veteran’s Staff Attorney, understands that it is not always easy to ensure elderly clients are not exploited. She was mindful to speak to Jim alone and confirm his competency. In doing so, Deanna was able to safeguard Jim’s wishes as his will was drafted correctly and notarized. Deanna was committed to protecting her client and providing him with the best possible service.

LSHV was able to help Jim protect his estate from falling into the hands of his abuser, and he now lives in peace, knowing that his final wishes will be honored.

Fortunately for Jim, he came to LSHV before it was too late to get the help he needed. Having a will is a critical step in assuring your wishes after you pass away. In 2022 LSHV Attorneys handled almost 1,000 cases involving Wills & Estates, Advance Directives, and Powers of Attorney. You do not have to be elderly to begin planning. If you or someone you know would like to discuss your options, please visit lshv.org and complete an online intake.
